The following is reported by BBC:

A radical preacher, who has been dubbed Osama bin Laden’s right-hand man in Europe, has been returned to jail after judges agreed he might abscond.

Abu Qatada had been held on a 22-hour home curfew, after winning the latest stage of a battle against deportation.

Judges have agreed with ministers that he might flee - even though there is no evidence of such a plan at present.
The cleric was arrested at his home in London in November. The UK wants to return him to Jordan.

Mr Qatada says his conviction there for terrorism offences was unfair.

A panel of judges at the Special Immigration Appeals Commission, which acts as the UK’s national security tribunal, heard last month that the 47-year-old Jordanian-Palestinian could be plotting to leave the UK.

One allegation related to a message on an extremist website which was said to call on an unnamed but influential Islamist preacher to join radical Islamist groups overseas.

MI5 intelligence

The Home Office alleged that Mr Qatada had also recorded a video sermon in his home, in breach of a key element of his bail conditions.

Mr Qatada denied these allegations, saying he had no idea about the online messages, while the sermon was in fact a home video in which he could be seen telling his children about a Muslim festival.

Other allegations, based on MI5 intelligence, were heard by the judges in secret and not put to Mr Qatada or released to the public.

The tribunal said the open allegations were not enough to deny the preacher bail - and that the Home Secretary accepted he had not yet breached his tough bail conditions.

The judges noted Mr Qatada and his legal team were looking in good faith for a neutral third country that was willing to take him - but added that was not a realistic prospect.

But revoking his bail, they ruled that material shown to them indicated a significant risk of absconding because of changes in circumstances and therefore they ruled that he should be returned to prison.

This is an unusual ruling for an immigration court and is similar to the position in criminal cases where an alleged serious offender is placed on remand before a trial.

Legal battle

Immigration rules allow someone to be held in prison only as long as a deportation is likely to ultimately take place.

But Mr Qatada was bailed in June after the Court of Appeal ruled he could not be sent to Jordan because his conviction there may have relied upon evidence obtained by torture. Ministers have now taken the case to the Law Lords.

The bail conditions, set in the summer, included wearing an electronic tag, a ban on attending any mosque or leading prayers. He has permission to leave his home twice a day for an hour each time.

He has been banned from using the internet, mobile phones and from meeting a long list of named people, including Osama bin Laden.

Home Secretary Jacqui Smith said: “I’m pleased the court has agreed that Qatada should have his bail revoked.

“He poses a significant threat to our national security and I am pleased that he will be detained pending his deportation, which I’m working hard to secure.”

Masha’Allah, the Shaykh reminds me of Shaykh Abu Muhammad al-Maqdisi and his wisdom and balance in the religion. Imam Anwar said on his blog:

Al-Hakim narrates with an authentic chain that Rasulullah was traveling with his companions when a bird came flapping it’s wings over his head. The Messenger of Allah said: ‘Who has brought grief to this bird?” One of the companions said: “I have taken some of its young ones.” Rasulullah ordered him to return them to their mother.

Rasulullah was leading an army on a travel for Jihad, the peak of Islam, but he was still teaching the sahabah about an issue as simple as mercy towards a bird.

There are some brothers and sisters who expressed concern when I talked about the opinions of scholars regarding cheese at a time when we have more important issues at hand that are of great concern to the ummah. I would like to take this opportunity to point out an important principle in Islam and that is: Islam is a comprehensive religion that covers all aspects of our life and every Islamic teaching is important. Rasulullah has taught us minute aspects of life that would otherwise seem trivial such as how to eat, growing a beard, and even manners of responding to the call of nature. If these were trivial issues Rasulullah would not have wasted his time teaching us about them, the Sahabah would not have narrated them and our scholars would not have documented them in their books of hadith and fiqh. The topic of cheese is even more important because it relates to what enters our body. It is enough to state that our dua would not be accepted if our food is haraam. So the rulings of diet are very important.

Some of these people who do not recognize the importance of the smaller issues told Salman al Farisi: “We see that your Prophet has taught you everything even about excrements” Salman said: “Yes he did. He taught us not to face qibla when urinating or defecating, not to use our right hands in washing ourselves, not to use less than three stones and not to use dung or bones” (narrated by Muslim and others.) The Messenger of Allah who taught us this was also a head of state and a leader of Jihad.

When one understands the wisdom behind the comprehensiveness of the teachings of Islam nothing is trivial anymore. When we understand that every moment in our lives, every movement, and every act should be for the sake of Allah we appreciate the reason why Rasulullah taught us about everything.

The problem is not in talking about the sunnah in matters that one may assume to be trivial but the problem is when one talks about the beard to the exclusion of Tawhid, wearing the clothes above the ankle to the exclusion of Jihad, or the miswak to the exclusion of wala and bara.
On the other hand, it is even a more serious problem when people occupy themselves with the mustahab ( the recommended) and ignore the major issues, some of which are issues of aqeedah. There are some that escape from the responsibilities that demand sacrifice to the safety of the easy rituals. We need to take Islam as a whole. We should follow Quran and the way of Rasulullah in all matters.

Sheikh Sayeed of Buriatia: ”How I went to Jihad and what I have seen here”

In summer of 2008, one of the most famous and authoritative proponents of Islam in Russia, Sheikh Sayeed of Buriatia (AKA Buryatskiy) joined the jihad in the Caucasus.

After arrival to Chechnya, Sheikh Sayeed of Buriatia stated that after the proclamation of the Caucasus Emirate none of the Muslims has any arguments on whether to stand aloof from Jihad.

“After the proclamation of the Caucasus Emirate all doubts had vanished. We have one Amir and one State. And direct obligation of each Muslim today is to come out to Jihad and help the Jihad in word and in property,” Sheikh Sayeed of Buriatia said.

Editorial staff of Kavkaz Center offers to its readers the video transcript of the statement of Sheikh Sayeed of Buriatia, recorded in autumn of 2008, who tells about how he went to Jihad and what he has seen in the Caucasus.

Praise be to Allah, the Lord of the worlds, and the final victory will be for those who fear Allah, peace and blessings of Allah be upon the most honorable of Prophets and Messengers, Prophet Muhammad, upon his family and those who followed them till the Day of Judgment. To proceed:

In a hadith narrated by Imam Muslim, Abu al-Husayn Muslim Ibn al-Hajjaj Ibn Muslim al-Qushayri al-Naysaburi, it is reported that the Messenger of Allah, peace and blessings of Allah be upon him, said:

“There will never seize to exist a group from my Ummah that will fight for the truth, those who forsake them will not harm them. Until the command of Allah comes and they will remain in such condition.”

And mentioning this hadith I did not want to make some stereotyped video or anything like that, but I have mentioned this hadith, in the first place, in order to explain a little bit the situation that forms in minds of our brothers regarding what is happening here. Why have I mentioned this hadith? Because the Prophet, peace and blessings of Allah be upon him, said:

“Those who forsake them will not harm them. Until the command of Allah comes and they will remain in such condition.”

By Allah, we know perfectly well that today Jihad has spread and widened, at one time it started here, in the territory of Chechnya, then it spread to entire Caucasus. By Allah, in the current situation of Muslims, Allah shows us very big miracles by supporting us and giving us strength to fight this Jihad, and if it were not for Him, nobody would stay here, in these forests, in these mountains, for a single day. Therefore the Prophet, peace and blessings of Allah be upon him, right away said that there would be those who would want to harm them, but they would not be able to achieve that.

As-Sahab Media:: Martyrdom of Heroes - And the Breach of Rulers by Dr. Ayman al-Zawahiri

Dr. Ayman al-Zawahiri talks about the 3 Shuhada’ of Indonesia calling them “steadfast heroes.” He said “they knew the price of their action and they paid it with satisfaction.” Talking about their long imprisonment, he said, “They faced a long journey of torture, imprisonment and oppression. They received the verdict joyfully.”

In addition, al-Zawahiri also talked about the treachery of the Saudi Kingdom. He said they were “working with the US and Israel to undermine jihadi resistance in Palestine, Afghanistan and Iraq.” He described a Saudi-sponsored U.N. conference on religious tolerance last month as a “ridiculous farce.”

The ridiculousness of “The Denudation of The Exoneration” November 29, 2008

[Sayyid Imam a.k.a., 'Abdul Qadir ibn 'Abdil 'Azeez]

As many of you know, about a year or so ago, a document was released from an Egyptian prisoner - supposedly Sayyid Imam - “refuting” Dr. Ayman al-Zawahiri. This document was entitled, “Document of Right Guidance for Jihad Activity in Egypt and the World.” The arguments used in the document itself was very flimsy and Dr. Ayman al-Zawahiri proved that in his powerful response to it entitled, “The Exoneration: A Treatise Exonerating the Community of the Pen and the Sword from the Debilitating Accusation of Fatigue and Weakness.”

Then once again, very recently, this prisoner released another document “refuting” Zawahiri, this time entitled, “The Denudation of The Exoneration.” The arguments used were mostly personal attacks on Zawahiri which no one can really confirm or reject since it’s hidden knowledge to everyone except a handful. For instance, he would accuse Zawahiri of working with the Intelligence Agency of Sudan (a long time ago) among other things. The majority of his arguments remain weak - and some are pure invented lies of stupidity that show pure political ignorance such as al-Qaa’idah told the US that the WMD’s are in ‘Iraq in order that the US would invade it (so that al-Qaa’idah could attack them) - and only a few are interesting to think over and might take time for an uninformed supporter of the Mujahideen to refute; however, everyone expects Zawahiri to respond to him again and we’ll see how he answers the trick questions (which we’ll discuss in another post). Honestly, I don’t think Zawahiri is going to waste much time on this “refutation” since those with eyes can see a lot of the extreme ignorance portrayed by the author (whoever it is); apparently, the author thinks that al-Qaa’idah demolishes homes of ‘Iraqi citizens. That alone tells you that the author’s sources of political knowledge is either heavily tainted or it’s simply written by an imbecile. Zawahiri will most probably focus on the personal attacks and clarify them.

I want to focus on one theme though and that is the validity of this actual document. Is Sayyid Imam really behind this document? If so, how is it possible without heavy support from the Apostate dogs that watch his movements all day long? Dr. Ayman al-Zawahiri explains this further very nicely in “The Exoneration” and I’m sure individuals like Imam Anwar al-Awlaki - who was a former prisoner in Yemen - would agree to some of the points. The author of “The Denudation of The Exoneration” really didn’t answer this critical part. He just kept repeating in a rhetorical way, “I am the one who wrote it, yes I did; Zawahiri is a liar”:

The document’s author then noted that some persons reject his document because a captive is not qualified or competent to make opinions. He said that the expression “a captive is not qualified” is not accepted as an absolute opinion and that Al-Mawardi and Abu Ya’la, may Allah have mercy upon them, said that the captive Imam remains qualified to make opinions unless he completely loses hope of deliverance. He added that his arguments do not acknowledge his captivity and that they should be judged by the proofs they present. He gave the example of Allah’s prophet Yusuf, peace be upon him, Imam Al-Sarkhasi, and Ibn Taymiyyah, may Allah have mercy upon them, who gave opinions while in captivity but their words were accepted.

This argument is deceptive in the following ways:

a – The document’s author said that the expression “a captive is not qualified” is not to be taken in an absolute sense and that a captive Imam would continue to be regarded as the Imam unless all hope of his release is lost. Now the document’s author is serving a 25 year sentence? Does someone serving such a sentence have any hope of release? Or has the government made promises to the document’s signatories and those who accepted it? Let them tell us what they were promised and what they agreed upon.

b – Additionally composing a treatise or a rationalization document, publishing it, making publicity for it, and distributing it inside and outside the Crusader campaign’s jails and its aides in Egypt needs three stages.

Firstly: The writer needs reference books and information about what is happening around him and current world events. A captive in Egyptian jails is usually under the total control of the organs of oppression and persecution, which control how much freedom he is given according to their own interests and the level of risk. This can range from complete isolation of the prisoner or giving him the usual level of freedom that those who reach an understanding with the government can get. The same applies to the information that reaches him. They can isolate him completely from the world or provide him with faulty information. They can allow him to contact his lawyers, some of whom are government agents or contact his family. The more dangerous a detainee is, the greater the isolation under which he is put.

Secondly: The writing stage. It is well-known that prisoners in Egypt are constantly searched and remain under surveillance and that the organs of brutal repression can look at most of what they write. They can deprive a prisoner of writing tools. Alternatively they can encourage him to write and provide him with what he needs to write something that will benefit them and their Crusader and Jewish masters.

Thirdly: The stage of publication and distribution. It is impossible to do this openly unless the aforementioned organs agree, let alone publish a document with an accompanying media brouhaha. The document was sold and money was paid for it. The organs of brutal persecution would never allow this unless it served their interests and those of their masters.

c – Consequently you cannot accept a coerced person’s approval of a document or, more significantly, his testimony. The proof is that any self-respecting judge, Muslim or non-Muslim, would not accept any detainee’s testimony that is written inside jail under the security services’ supervision. He would require the prisoner to appear personally before him to ensure that he is giving his testimony freely.

d – A captive’s testimony that serves his captor and tormentor is unreliable because he is under his captor’s control. A testimony serving the captor is unacceptable although it is acceptable if it is against the captor. Therefore the document author’s testimony about the Mujahideen’s impotence is unacceptable. It is unreliable because it serves his oppressors’ interests, from which the testimony of the Mujahideen about their readiness to continue the fight is safe. Likewise unacceptable is his testimony that Jihad against the Crusaders, the Jews, and their agents has had terrible consequences because it was produced under oppression. The Mujahideen’s own assessment of gains and losses is safe from this assessment.

e – When the document’s author compares his situation to that of the prophet Yusuf, peace be upon him, Imam Al-Sarkhasi, and Ibn Taymiyyah, there is a difference. They did not make testimonies that benefited their captors against the captors’ opponents. Their testimonies, fataawa, or conveying of knowledge were not under suspicion. The document author’s testimony is. For this reason the words of the prophet Yusuf, Imam Al-Sarkhasi, and Ibn Taymiyyah were accepted but the testimony of the document’s author about strength and weakness and gains and losses is rejected.

This document was written in the spirit of the Interior Ministry and to serve its purpose of maintaining public order. The writer urged the Muslims not to carry out any act against the government, no protests, sit-ins, meetings, or demonstrations. He called on them not even to collect money to help the captives’ families, let alone support Jihad with money even in the countries and battlefields where the author does not object to Jihad’s legitimacy. Why all this? Do all these acts disrupt public order?

How could such a document be accepted? First release the writer from prison and allow him to live in a place where he and his family feel safe and then he will be free to speak his mind.

Shaykh Abu Yahya al-Libi on the Taliban November 28, 2008

The Mujahid Shaykh, Abu Yahya al-Libi - hafidhullah - said regarding the Taliban:

“Our brothers the Taliban, all praises and thanks belong to Allah, are a group of action and learning with the ‘Ulema as the leaders and the students as the troops. Those who know them or live with them in war and peace, prosperity and hardship, realize that they are people of piety, faith, and a search for righteousness on numerous issues. If you asked any individual, he would not need to scratch his head before he answered.

It is enough to say in all fairness and frankness that it is the only contemporary Jihadi movement that was raised by the ‘Ulema and their students, both leaders and grassroots. They have been its vast majority before it came to power and during its governorship and will be again when it returns to power, Allah willing. When people ask when, answer soon, hopefully.”

As-Sahab Media:: Shaykh Ayman al-Zawahiri - Al-Azhar: The Lion’s Den [English]

This is a powerful release from As-Sahab Media. It is an interview with Dr. Ayman al-Zawahiri on many of the recent events of this year. This release is actually a few months old since it was completed before ‘Eid al-Fitr and as we know, ‘Eid al-Adha will be next week, In Sha’ Allah. The Shaykh covers many important topics as usual and shows some surprising clips that many of us don’t catch in the media and documentaries that are made by Westerners. The theme of the release is focused around al-Azhar’s prestigious history of the Scholars it has produced and their unwavering faith in confronting the enemies of Islam. It surely is something to think about; if al-Azhar were to be like it was in the past - free from the Government - a part of the current American-led Crusade would have been easily dismantled since it is America who has its governmental puppets control the ‘Ulema and if the ‘Ulema show amazing sacrifices in their actions for the Ummah - and are willing to go through harm just to uplift the Ummah’s condition - then this would undoubtedly lead to a massive support for the Global Resistance against the Crusade.

It is amazing how the ‘Ulema have a lot of control and influence in the Ummah… only if many of them decide to use it for the greater good.

When we were isolated from the world and forbidden from family visits and from contacting the outside world, I did not see in my solitary dungeon except the delegates from the Red Cross and the pigeons and birds standing on the bars of my dungeon, looking for crumbs of bread I used to scatter for them so they would keep me company with their cooing and singing.

The same goes for the delegates of the International Committee of the Red Cross (ICRC); as the mere appearance of a delegate gave us joy and happiness because it meant receiving news from family and letters of longing from loved ones. In many cases, their visits helped lessen the pressure of the prison administration practiced on many detainees. Sometimes, ICRC delegates would bring us books to read, which made us jump with joy in the midst of our isolation as book prohibition is practiced by the authorities.

In my case, my situation was given special attention by the ICRC because of the long period I spent in solitary confinement. Anyone who knows me and knows my passion for books and for reading would know that the greatest punishment for me in confinement was depriving me of them. The prison administration knew that very well and practiced this deprivation with me. It deprived me of books, withheld them from me, and confiscated the ones I had, and the ICRC delegates honestly fought to break this siege off me with all their energy and abilities, in a way I will never forget for them. After a lot of effort, they were able to bring in the ICRC [Arabic] periodical magazine “al-Insani”. It was the first appearance for us from the outside world which we were isolated from, even through the signals transmitted within the information on the ICRC activities. No one can appreciate this unless they suffered as we did. We awaited this magazine in spite of its lack of international news, as it was not a news bulletin, but a magazine of information on the ICRC activities. However, the isolation we suffered made it our first and only news bulletin.
